Some Western Australian Acts refer to “Penalty Units” (PU) when setting amounts for fines which can be imposed. The Acts which refer to PU’s are predominantly those dealing with road and driving laws, such as the;
- Road Traffic (Authorisation to Drive) Act 2008 (WA);
- Road Traffic Act 1974 (WA)
- Road Traffic (Vehicles) Act 2012 (WA);
- Road Traffic Code 2000 (WA).
For example, an infringement notice for exceeding the speed limit by not more than 9km/h carries a fine of “2 PU”. The amount of a PU is currently $50.00. This is found in s.7 of the Road Traffic (Administration) Act 2008 (WA). That means the infringement notice for the speeding carries a fine of $100.00.
The value of a PU can be changed at any time by the Government amending the relevant Act.
